So I'm fighting in the tavern, killing swains, when I accidentally roar in between attacks. In a combat area (the tavern in Ratha), I got this message:

I am in a combat area. I had just killed a swain when I accidentally roared. That's something my character can get arrested for, in a combat area? This seems very silly. Can someone explain this to me, please? I roar in there all the time, I just accidentally did it without a foe in front of me. (curses the keyboard and my clumsy fingers) How long do I have to hide out in the tavern before I get hauled off to jail, which is always annoying. (I got caught once for tripping a gas trap on a box, which I didn't realize was illegal in the city limits. Oy, so many rules)

This is an issue with the Ratha justice system. I believe this was brought up a while back, and the result was, as you said, roars with critter in room are ok. Roars with no critters tick off the locals.

Also, if you use serpent's hiss of warning, and it scares ALL of (swains for example), you'll get in trouble.

When I hunted in swains the only time the guards were called when I roared is if there were no swains alive in the room. Don't know if this is still the case.

In my experience, the guards get called when your roar affects all of the swains in the area. Or if it affects a person.

I've been hunting in swains and here's what I found (keep in mind this is inside the tavern, I've never roared when fighting them on the street outside).
If I use a standard roar with swains in the room, guards are not called regardless of how many swains are affected by the roar.
If I use Serpent's Hiss of Warning and ALL swains are affected and flee the room, then guards ARE called.
If I use Serpent's Hiss of Warning and fewer than all swains are affected (meaning one or more swains are left in the room), then guards are not called.
I've never tried roaring without any enemies in the room.
