The options are the same for Empaths as they are for everyone else. You can do one (but not more/all) of the following: You can attack them yourself. You can have a bonded spouse attack them. You can turn them into the city guard if it was within a justice area (go to the guard house and "ACCUSE <full, capitalized name of the person that robbed you>" within a short period of time).

Judging by past calls I've seen, I would say be very, very careful.

It's deliberately vaguely set as "reasonable amount of time." I wouldn't expect to be able to wait more than a few hours to attack a pickpocket unless they stole a lot of money from you.
I personally think it's really excessively bad form to do something like rob someone then turn around and report them for attacking you even a week or a month later but a lot of people in this game are like that. So be careful. If you're unsure it's better to just suck it up and move on rather than risk a warning over something and someone stupid.

If you catch them stealing from you, you can accuse the Thief to the guards. This hits them with a reasonably large fine and a hit to their bonus if they're a gilded Thief. If you accuse the Thief to the guards successfully, then the conflict is over, you can't go hunt them down after that and stay within the consent rules.
If someone else sees them stealing but you don't, you don't have consent. You can, however, use the watch verb on the person, which will make it a whole lot harder for them to steal from you or hide around you -- it basically gives you a gigantic bonus to your perception versus that one person, while making you less perceptive versus other people. This also lets the Thief know you are onto them.
There's as time limit on consent, but it's not strictly defined. If you catch someone stealing from you, it's best to act within an hour or so if you're going to act at all.
The best way to avoid this sort of situation is to carry only small denominations and keep your gem pouches closed.
One thing I don't see people use that often -- some traders used to carry cursed gems in open containers for Thieves to "find." I'm not sure how the curse mechanics work these days, but if you could figure out a way to get some cursed gems into a pouch for Thieves to steal, well, that would be pretty funny.
If Szrael caught someone stealing from her, she would attack them whether or not she thought she would win, using every dirty trick at her disposal. But Szrael is a bit bloodthirsty.

Clear Vision runes are nice to keep around too.

It was sort of mentioned, but be aware if you watch someone, they will see a message that says something along the lines of "You notice <name> watching for you." every little bit. And if you're watching someone, you have reduced perception against everyone else.
