So say you catch a thief in your pockets, and end up getting killed by said thief, defending himself. Thief then takes your weapon and logs. Cant the graverobber just log back in at 4:00 in the morning and sit in hiding to keep the weapon?

Not really, if the person logs the stuff they picked up will go back to the gravesite.

If they immediately log out (or rather, log out during the GR countdown), the items are sent back to the room you died. If you aren't there and there's not a lot of traffic, it's %90 likely it's in the janitor's closet and not coming back.

If they let the timer run out, then mechanically they can do whatever they want with it until you retrieve it or give up trying.

Items dropped upon death are mechanically identical to items you take out of a grave.
