In the cloak you see a midnight black spiked whip.

The black spiked whip crumbles and decays away.
This is the third weapon I've found that should have decayed the moment I touched it yet not only was I able to pick them up I was able to even stow them in my cloak. What causes this to happen? Each time I find a weapon I know should crumble away I keep thinking "Maybe this weapon just happened to spawn to look like the rest."

The weapon won't crumble until the owning creature is slain.

Toothpicks are placed on the ground and then upon one another with participants taking turns. As the stack grows it takes more skill and luck to place the next one. Whoever causes the stack to topple is out of the round.

Not sure if this jives with your experience, but I believe this type of weapon doesn't crumble until the creature that genned with it dies (or maybe is looted). So if you disarm or knock an arm off or something, you can pick it up before you kill its owner and it'll hang out for a while. I've definitely picked up a cursed weapon in the rift, only to have to find some way to kill the creature (which is tough, since I only hurl) so it'll crumble.

You can even use the weapon after the creature disappears, BUT only as long as you keep it in your hand. Try to stow it or something, and it will then go poof.
